But as per new provision of Income Tax, fine of Rs. 10,000 may be levied in

the latest amendments in the Finance Bill 2019, not only allowed people to use

the new penalty rules are applicable only in cases where you are using Aadhaar

well known that although Aadhaar is issued by the Unique Identity Authority of

Section 272B of the Income Tax Act, 1961, the department can impose a penalty
in case of default in complying with provisions relating to PAN, i.e., failure
to obtain, quote, or authenticate PAN. The amount of penalty shall be Rs. 10,000
for each default.<o:p></o:p></span></div>

though having potential tax liabilities.</span></div>

While identifying non-filers of return through NMS, the Income Tax Department
analyses and assimilates all in-house information as well as transactional data
received from third-party including Annual Information Return (AIR), Tax
Deduction at Source (TDS) and Tax Collection at Source (TCS) statements,
Central Information Bureau (CIB) data etc, to isolate such persons/entities who
have undertaken high value financial transactions but have not filed return. A
total of 79.08 lakh such non-filers have been identified since implementation
of NMS in 2013.<o:p></o:p></span></div>

have been getting report from our field formations that though promotion orders
have been issued in almost all charges, the Cadre Controlling Authorities in
some charges have not taken the consequential vacancies while conducting DPC
Meetings and effecting promotions. The reason communicated to us by our units
is that some of the CCAs have taken the stand that although the vacancies are
for RY 2013-14 as the promotions are being effected in the year 2014-15, the
consequential vacancies will fall in the year 2014-15. The Stand taken by the
CCAs is absolutely contrary to the <span style="color: #c00000;">Instructions of
the Dept. Of Per. & Trg. dated 10.4.1989</span> with regard to determination
of vacancies for DPC. This will also create problem and confusion in fixing the
inter-se seniority of Direct Recruitees and Promotees and may lead to
unnecessary litigation if the vacancy year for the consequential vacancies of a
particular year is taken to a subsequent year in some regions. We reproduce
below further clarification of para 4.1 of the said instructions of the DOPT.<o:p></o:p></span></i></div>

it, the zone of consideration would also get enlarged in a corresponding manner

as follows 2118 + 150 + 39 + 230 which is notified vacancies reserve deficit
and regular ones. The process of CR will be in place latest by September 2014.
It may be added here that a onetime relaxation from the DoPT is required which
is at best a technical formality since the CR already been approved by the

issued a circular providing the status report on Promotion to ACIT for the R.Y.
2013-14 . ITGOA stated that the CBDT had submitted two Review / Regular
proposals for promotion to the post of ACsIT to UPSC on 18.02.2014. CBDT was
advised by UPSC to obtain opinion of DOLA on the issue as to whether holding
DPC from the existing seniority list of ITOs subject to revision of seniority
of ITI / ITO based on the judgment of Hon'ble Supreme Court in NR Parmar will
tantamount to contempt or not. <o:p></o:p></span></div>

the Board for obtaining views of DoPT and to clarify its stand taken before the
Hon'ble Supreme Court in the contempt petition titled as' Virender Kumar vs Dr.
Sudha Sharma, ex-chairperson, CBDT '. The CHQ has been pursuing the matter at
all levels in CBDT as well as other agencies involved in the process. The CBDT
clarified the relevant issues placing reliance on the opinion dated 05.05.2014
of DoPT, clarifying the O.M. dated 04.03.2014 and sent the matter for
examination to DOLA in first week of June, 2014. After considering the facts,
the DOLA has opined that the matter can be taken up with the UPSC for holding
DPC subject to determination of final seniority in terms of judgement of the
court in N R Parmar's case.</span></div>

CBDT to UPSC again around 3 weeks back after obtaining the advice of Department
of Legal Affairs. <o:p></o:p></span></div>

<span style="font-family: "Comic Sans MS"; font-size: 12.0pt; line-height: 115%;">In the mean time, the UPSC has
pointed out it has received representations froma few officers of the
Department requesting for postponement of the regular DPC objecting to the
review DPC and asked for comments of the CBDT. It has also come to our
knowledge that the UPSC has written another letter to the CBDT, two days back, asking
for status of implementation of NR Parmar judgement. While all out efforts are
being made to get a date from UPSC by the ITGOA CHQ, the action of a few of our
members coupled with the indifferent attitude of CBDT are all contributing to
the further delay in the promotions. Each one of us has the right to contest
for his / her legitimate right / seniority position and the CHQ is putting its
sincere effort to force the Authority to implement the Judgement of NRParmar
and to recast the seniority list of ITOs as early as possible but we must not
forget that by bringing stay either from the Court or writing letter to the
UPSC thereby stalling the DPC and complicating the matter will jeopardize the
career prospects of our own members only. <o:p></o:p></span></div>
<div class="MsoNormal" style="text-align: justify;">

<span style="font-family: "Comic Sans MS"; font-size: 12.0pt; line-height: 115%;">The root cause of this problem is
the non implementation of NR Parmar judgement in a time bound manner. We have
taken up the issue with the CBDT for not only uniform implementation of the
judgement but within a fixed time period including review DPCs in all the
regions so that the issue reaches its finality. The major hurdle in this issue
is the indifferent attitude of the CBDT. In spite of our several letters and meetings
with the authorities of the CBDT, the Board is sitting idle over the issue by
not fixing the deadline for implementation of the judgment in all the regions. <o:p></o:p></span></div>
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Comic Sans MS"; font-size: 12.0pt; line-height: 115%;">The implementation issue was also
discussed in the last JCA meeting held on 02-06-2014 and it was decided to
include it as one of the issues in the JCA Charter of Demand, already submitted
to the Board. The Board has called for quarterly review meeting on 14.07.2014
and we are definitely going to raise the issue for time bound implementation of
N.R.Parmar judgement. The CHQ has been pursuing the matter at all levels in
CBDT for DPC against CRC vacancy for RY 2013-14 & 2014-15 and regular
vacancy for RY 2014-15 and requested the Board to initiate the process
immediately. We have been assured that process will start immediately once the
DPC for the regular vacancy for RY 2013-14 is completed. <o:p></o:p></span></div>

available in the cadre of ACIT / DCIT. The CBDT has to first of all finalise
the All India seniority list in the cadre of Income-tax Officer. The same can
only be done once the seniority list in all the regions is revised and updated by
holding review DPC for promotion from Inspector to Income-tax Officer in the relevant
years. This exercise should be done by following same and uniform guidelines throughout
the country within a fixed time period. The CHQ has already initiated necessary
steps. For his purpose, data for uniform implementation of NR Parmar is asked
from all the units. A committee has also been formed to study the seniority
fixed in various regions and suggest corrective steps. The General Secretaries
of Units are requested to comply the same early and facilitate the matter. It
was further decided to visit all the Units and apprise about the indifferent attitude
of the Board not only in the case of promotion to the cadre of ACIT but in all other
issues. We believe that it is possible to reverse the indifferent attitude of
the Board through unified efforts only.</span></div>

the RRs for all group B & C cadres have been finalized and submitted to the
Secretary (Revenue) for approval. The same will be submitted to the Department
of Personnel for its approval. The CHQ is pursuing the matter for its early
clearance. The instructions for conducting the DPCs for the RY 2014-15 will be
issued only after approval of the RR. In the event of delay in getting the RRs
approved, alternative ways will be explored for filling up of the posts for RY

JCM to submit only one Memorandum on behalf of all the organization on minimum
wage and other common issues were reported in detail. Accordingly, the staff
side has completed the draft memorandum on all common issues. The JCA is, fully
endorsing the same. As far as the Memorandum on Department specific issues are
concerned, the principle for draft memorandum has also been finalized. As far
as the status of common categories are concerned, the same will be communicated
after finalization by the Confderation of Officers Associations and Staff Side
on the issue. The gist of the Staff Side Memorandum, with proposed pay scales
and gist of the JCA Memorandum with proposed pay scales are annexed to this
circular. This is to enable you to discuss in your decision making body and
communicate your suggestions, if any, to the CHQ. You are requested to
communicate the same to the CHQ by 10th of July, 2014. The final report, after
consideration of the suggestions received from the Circles will be placed
before the Secretariat which is scheduled to meet on 18th July, 2014 at New

in this regard. The notification of revised Recruitment Rules for these grades
is currently under process. Also, new Recruitment Rules are to be notified for

take some more time and it would not be advisable for conduct of DPCs after

TA & Steno Gr. I (which would merge into the single cadre of Executive

utilized by DPCs. In other words, DPCs for promotion of Sr.TA to OS, TA to
Sr.TR & Steno Gr. II (erstwhile Steno Grade 111) to Steno Gr. I are to be
conducted.</span> For the limited purpose of quantifying vacancies for conducting
DPCs, the number of posts notified for the EA grade may be further trifurcated
in each CCA region among OS/Sr. TA/Steno Gr. I in the same ratio as the
pre-restructuring number of sanctioned posts in these grades. <o:p></o:p></span></div>
