New Income Tax Rules – Submission of false Aadhaar number may be fined Rs. 10,000

As it is well known that the income tax department has allowed Aadhaar card holders to use the biometric id number in lieu of the Permanent Account Number (PAN). But as per new provision of Income Tax, fine of Rs. 10,000 may be levied in case of wrong Aadhar Number. As per the latest amendments in the Finance Bill 2019, not only allowed people to use Aadhaar in lieu of PAN but also introduced a penalty for giving a false Aadhaar number. However, the new penalty rules are applicable only in cases where you are using Aadhaar in lieu of PAN and where quoting PAN is mandatory according to the income tax department rules. It is well known that although Aadhaar is issued by the Unique Identity Authority of India, yet the fine is not imposed by UIDAI but by the income tax department. Under Section 272B of the Income Tax Act, 1961, the department can impose a penalty in case of default in complying with provisions relating to PAN, i.e., failure to obtain, quote, or authenticate PAN.

Cadre Restructuring in CBEC: Notification issued

A fter the approval of the competent authority, the order specifying the staff allocation for the new formations has been issued yesterday. This is the first step for the implementation of the cadre restructuring in CBEC. Chairperson, CBEC herself stated in her message that t he benefits of the restructuring will depend on its speedy implementation. Dearness Allowance will be increased by 7% w.e.f. July 2014

After the issuance of press release by Ministry of Labour and Employment, it is confirmed that Central employees and pensioners are going to get a 7% increase in Dearness allowance with effect from 1st July 2014. Consequent to 2 points increase in the All India Consumer Price Index for June 2014, the final calculation for D.A. from July 2014 can be done. The increase will have to get cabinet approval and expected to be officially endorsed in the month of September as per existing norms. View the press release here

ITEF writes letter to Chairman, CBDT regardingg Consequential Vacancies of R.Y. 2013-14

ITEF has written a letter to the Chairman, CBDT regarding consequential vacancies of R.Y. 2013-14Copy of ITEF letter No. N-1/E-2/12-15 Dated: 28th July, 2014. Vide the second reference dated 27.05.2014, the CCAs were required to conduct the meetings of DPCs and effect promotions for the Group B & C cadres by 5th June, 2014 for vacancy year 2013-14. We have been getting report from our field formations that though promotion orders have been issued in almost all charges, the Cadre Controlling Authorities in some charges have not taken the consequential vacancies while conducting DPC Meetings and effecting promotions. Status of the cadre restructuring in CBEC

The proposal for DPC to the post of AC against 421 regular vacancies may be sent to the UPSC next week. CBEC approached the UPSC for the DPC of 421 (regular)+2118 (temporary) posts of AC. UPSC agreed to conduct the DPC for 421 regular posts first and asked the CBEC to get relaxation in RRs against filling-up of 2118 temporary posts as all of these posts are to be filled-up only by promotion instead of 50% by direct recruitment and 50% by promotion. The Member (P&V) assured to send the proposal for the DPC against remaining 2118 temporary posts very soon. Staff allocation file is already with MOS, for which she has asked for presentation. Reorganisation notification is to be issued after approval of budget to make the due amendment in the Act.

ITEF's New Circular on Various issues

INCOME TAX EMPLOYEES FEDERATION, New Dehli has issued a new circular on the minutes of secretariat meeting held on 23.07.2014. Issues of Memorandum to VII CPC, Diversion of Cadre Restructuring posts and other various issues were discussed in the meeting. Income Tax offices will remain open on Saturday and Sunday, the 26th and 27th July to receive returns as the due date of filing of return is 31st July 2014. All field offices will accept returns during normal office hours. Special arrangements may also be made by way of opening additional receipt counters, wherever required, on 26th, 27th , 28th, 30th and 31st July, 2014 to facilitate the taxpayers in filing their returns of income conveniently and in a timely manner. It is reliably learnt that the file of IRS (IT) officers belonging to 1982-87 batch has reached to the Appointment Committee of Cabinet on July 16. DPC had taken place on April 30 this year. STATUS OF CADRE RESTRUCTURING IN CBEC

The Chairperson, CBEC on 18-7-2014 has issued directions to the Competent Committee DPC to address the UPSC with a proposal to conduct DPC for the promotions to AC Cadre at the earliest. This will be done under a single window scheme to avoid procedural delays and bottlenecks. The break up of vacancies is as follows 2118 + 150 + 39 + 230 which is notified vacancies reserve deficit and regular ones. The process of CR will be in place latest by September 2014. It may be added here that a onetime relaxation from the DoPT is required which is at best a technical formality since the CR already been approved by the Union Cabinet. STAGNATION Committee has also being constituted to mitigate the acute stagnation in all cadres independent of CR.

Status of promotion to ACIT for R.Y. 2013-14

INCOME TAX GAZETTED OFFICERS'ASSOCIATION(ITGOA) issued a circular providing the status report on Promotion to ACIT for the R.Y. 2013-14 . ITGOA stated that the CBDT had submitted two Review / Regular proposals for promotion to the post of ACsIT to UPSC on 18.02.2014. CBDT was advised by UPSC to obtain opinion of DOLA on the issue as to whether holding DPC from the existing seniority list of ITOs subject to revision of seniority of ITI / ITO based on the judgment of Hon'ble Supreme Court in NR Parmar will tantamount to contempt or not. DOLA referred back the matter to the Board for obtaining views of DoPT and to clarify its stand taken before the Hon'ble Supreme Court in the contempt petition titled as' Virender Kumar vs Dr. Sudha Sharma, ex-chairperson, CBDT '. The CHQ has been pursuing the matter at all levels in CBDT as well as other agencies involved in the process. ITEF's New circular on CR and VII CPC

ITEF issued a new circular on various issues. The contents of the circular is as under “Cadre Restructuring and filling up of posts. We hope by this time in all Circles the process of filling up of Additionally allotted posts of Cadre Restructuring including consequential vacancies for the RY 2013-14 in the cadres of Group B & C would have taken place. In any Charge, if this has not been completed or only partly done, the same may be intimated to the CHQ with reasons for the delay for taking up the matter with the Board for further necessary instructions. As informed in the CWC meeting held on 1st June, 2014, the RRs for all group B & C cadres have been finalized and submitted to the Secretary (Revenue) for approval. Press Release about Government's plan to make six days a week working in the administrative offices of Central Government.

As per the press release of 14.06.2014 by Secretary (Staff Side), National Council (JCM) on the present whispering about reverting back to six days a week in place of the prevalent five days week working in the Administrative Office of the Central Government, It is stated that the issue was discussed by Shri Shiva Gopal Mishra, Secretary Staff Side, National Council (JCM) and General Secretary, All India Railwaymen's Federation, with the Cabinet Secretary on 13 th  June, 2014, and it was brought to his notice that five days a week working was introduced, way back in the year 1985 after prolonged deliberations at the National Council (JCM) level. Various aspects, including energy saving in the form of electricity and also Statutory Provision regarding working hours were kept in view. After discussion, Cabinet Secretary assured to Secretary Staff Side NC / JCM, Shri Shiva Gopal Mishra, that no such proposal is under consideration with the Government at present. View the

Pr. CCIT, Bangalore issued promotion order and OM

Promotion order of 100 inspectors and 102 ITOs have been issued by Pr. CCIT, Bangalore. It is also learnt from the order that TA batch who joined the department in the year 2007 & 2008 and got promotion as Sr. TA in the year 2011 & 2012 also promoted as Inspectors of Income Tax. Prior to this, the same has been seen from the promotion order released by Delhi Region. This is very good sign of benefits of cadre restructuring. Eligibility of officers to be considered for promotion by DPC- Fixing of Crucial Date

As per the new OM of DOPT published on 28th May, 2014 i t has been decided that the crucial date of eligibility shall be 1 St   April of the   vacancy year in case of financial year based vacancy year i.e. where the Annual   Performance Appraisal Reports (APARs) are written financial year-wise. In case of   calendar year based vacancy year, i.e. where APARs are written calendar year-wise, the   crucial date of eligibility shall remain as 1 st   January of the vacancy year. These   instructions shall come into force in respect of vacancy year 2015-16 (financial year)   commencing from April 1, 2015 and vacancy year 2015 (calendar year) commencing from   January 1, 2015 and shall, accordingly, be applicable to all such subsequent vacancy   years. Instruction by CBDT to conduct DPC for R.Y. 2013-14

Finally, CBDT broke the silence in respect of conducting DPC for the vacancies created due to implementation of cadre restructuring. Today, CBDT itself issued a instruction for conducting of DPCs for vacancy year 2013-14. The contents of the instruction is produced below which is self explanatory: “ Subject: Instructions for conducting of DPCs for vacancy year 2013-14 -reg. Kindly refer to the subject mentioned above. DPCs are to be conducted for Group B & C grades (and also for the posts of Pr. Administrative Officer, which is a Group 'A' post) by the Pr. CCsIT for the vacancy year 2013-14. The DPCs have to take into account the increase in number of posts in these grades as a consequence of Cabinet approval in this regard. The notification of revised Recruitment Rules for these grades is currently under process. Also, new Recruitment Rules are to be notified for the Executive Assistant grade. All this is likely to take some more time and it would not be advisable

Is post of Income Tax Inspector is now Group 'B' Non Gazetted or It is a Mistake?

Surprisingly, Delhi Region in its recently issued promotion order from officials to Inspectors, mentioned " Non Gazetted Group ‘B’ – Promotion to the cadre of Inspectors"  as its subject. Now the question is whether the post of Inspectors came under Group ‘B’ or it was only a mistake? This is a common question whispering in the corridors of Income Tax Department. Also, there is a deep silence on the side ITEF and ITGOA in the matter. 

Pr. CCIT, Delhi Region promted 234 ITIs to ITOs

Pr. CCIT, Delhi Region promoted 234 Income Tax Inspectors to Income Tax Officers.  On promotion, the officers mentioned at serial no. 1 to 34 would report on duty to the office of Pro Chief Commissioner of Income-tax, New Delhi and would function as Officer on Special Duty, till further orders. The remaining officers mentioned at 35 to 234 are posted as ITO (OSD) on in-situ basis at their present place of posting till their formal posting orders and they will continue to discharge the function of the present post. New RR may be issued on Monday?

New Recruitment Rules for ITIs is finalized and the notification in this regard may be issued on Monday or next week. It is also learnt that Stenographer quota and YOP seniority criteria have been removed. Also most of the officials who are not eligible for next promotion as on 01.01.2013 are curious about one time relaxation so that they can be promoted. As regards to recent promotion made by Delhi region, officials who were qualified ITI exam till December 2012 are considered for promotion for ITIs. Also in some of the regions, promotion order from ITIs to ITOs and officials to ITIs may be issued in next week.  

Delhi region promoted to 194 inspectors
